With reference to your letter of 28th June, 1901, No. 129/3 on the subject of the proposed new dock at Kowloon, I have the honour to acquaint Your Excellency that the Commander-in-Chief has expressed his approval of my reply of 3rd July provided that the Dock Company will state in writing that it is clearly understood that their promise, proposed as a modification of condition 1 (viz:- to submit plans of the projected dock to the Naval Authorities and to endeavour in every way to meet their wishes) is an engagement on the Company's part to make alterations if the plans submitted are not found satisfactory by the Naval Authorities.

It is essential that condition 3 should be insisted on; it ought not to prove onerous and perhaps the Company's own proposals, under Paragraph 3 of their letter of 28th June, 1901, may prove acceptable when they are defined.
